Dr. Glenn Stewart sues Lafayette Police Department over arrest before 2012 Independent Parade

Dr. Glenn Stewart, the man accused of punching a woman before the Independent Parade rolled last year, is suing the Lafayette Police Department and Lafayette Consolidated Government. The lawsuit claims Stewart, a former cancer doctor, was falsely arrested, falsely imprisoned, and among other claims was maliciously prosecuted.

Stewart was charged with felony second degree battery for allegedly punching Erin May Fitzgerald unconscious, but the lawsuit says Stewart was just defending himself. It all started with Stewart’s float that ran in the parade. It featured a large cutout of Fitzgerald’s stepmother, Cherry Fisher May, one of the Independent Weekly Publishers. A banner pinned to the side of the float mentioned her DUI charge. Police said Fitzgerald tried to remove the banner.

According to the lawsuit, Stewart walked off the float to see what was happening and was “bull rushed” by Fitzgerald and her stepfather, John St. Julien. “The fracas between Dr. Stewart and the Fitzgerald-St. Julien conspiracy has every indicia of being pre-planned, preconceived, and completely contrived scheme whereby Ms. Fitzgerald and Mr. St. Julien [sought] to implicate Dr. Stewart in a criminal act,” attorneys Christopher Alexander and Stephen Spring II said in the lawsuit.
