Former NOPD officer sues shooting suspect, family

A former New Orleans police officer has filed a lawsuit against the people who opened fire on him in 2012.

Police officers got into a shootout with two brothers, Justin and Earl Sipp, in a Mid-City neighborhood in March 2012. Officers said they stopped the brothers on charges of driving recklessly, when Justin Sipp got out of the car and opened fire on them. Justin Sipp was shot and killed, while Earl was injured, investigators said.

Family members filed a wrongful death lawsuit against the officers and the New Orleans Police Department in federal court, but one of the officers involved has also filed a new lawsuit.

Eric Hessler, with the Police Association of New Orleans, filed the lawsuit on behalf of former NOPD Officer Jason Giroir in Orleans Parish. Two officers were wounded in the gunfire. Authorities said Giroir was not injured, but he returned fire on the Sipps.
